01The parties
These Terms & Conditions ("Terms") govern the supply of CAPE custom-fit compression garments by CAPE Bionics Pty Ltd (ABN 12 345 678 901) ("CAPE", "us", "we") to the customer ("you", "the Patient", "the Buyer"). By placing an order — whether directly or via a CAPE-authorised partner clinic — you agree to be bound by these Terms.
02Orders & prescriptions
CAPE garments are TGA-listed Class 1 medical devices. Therapeutic-grade garments require:
- A 3D body scan performed at a CAPE-authorised clinic by a trained prescriber.
- A valid clinical referral or prescriber note where indicated.
- Buyer consent to manufacture based on the supplied scan and prescription parameters.
Sport and travel garments are available without clinical referral but still require a 3D scan to ensure correct sizing.
Each garment is manufactured to your unique specifications. Once an order has entered production (typically within 48 hours of scan submission) it cannot be cancelled.
03Price & payment
Prices are listed on our website in Australian Dollars (AUD) inclusive of GST. Prices may vary at clinic level depending on consultation fees charged by your prescriber. Payment is due in full at the time of order, by card, via private health fund where eligible, or via the NDIS where approved.
04Manufacture & delivery
Standard manufacturing time is 5–7 business days from receipt of a complete and approved scan. Garments are shipped from Melbourne via tracked courier. Delivery times within Australia are typically 1–4 business days; international shipping varies by destination.
05The CAPE Guarantee
If your CAPE garment does not fit correctly on first wear, we will adjust, remake, or replace it at no charge — guaranteed. The CAPE Guarantee covers fit only; it does not cover misuse, accidental damage, or wear beyond expected garment life.
To activate the Guarantee, contact your prescribing clinic within 14 days of receipt.
06Warranty & refits
CAPE garments carry a manufacturer's warranty against material and workmanship defects for 6 months from delivery. Expected garment life under normal use is 6–9 months; this is a function of fabric science, not warranty.
Significant change in body shape (e.g. post-surgical, weight change, pregnancy) may necessitate a fresh scan and new garment. CAPE offers discounted refit pricing in these circumstances.
07Returns & refunds
Because CAPE garments are custom-made medical devices, statutory cooling-off periods do not apply. We will, however, offer a refund or remake where:
- The garment is faulty or fails to meet acceptable quality standards under the Australian Consumer Law.
- The garment was incorrectly manufactured to specification.
- Fit cannot be achieved within the terms of the CAPE Guarantee.
08Liability
To the maximum extent permitted by law, CAPE's total liability arising from the supply of any garment is limited to the price paid for that garment. Nothing in these Terms excludes or modifies your rights under the Australian Consumer Law.
09Intellectual property
The AutoTailor pattern-generation algorithm, CAPE knit and pressure profiles, garment designs, and all related technology are the intellectual property of CAPE Bionics Pty Ltd and protected by patent, trademark, and copyright.
10Governing law
These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
